Terms of Use

These Terms of Use govern your use of the Borah app (iOS and Android), the website borahsp.com and the service behind them. By using Borah you agree to these terms. If you do not agree, do not use the app. The Brazilian Portuguese version is the reference version.
1. Who we are
Borah is operated by Eduardo Torres Lopes, a natural person (not a company). General contact: contato@borahsp.com. Privacy and personal data matters: privacidade@borahsp.com.
2. What Borah is
Borah is a discovery guide to cultural and nightlife events in São Paulo, Brazil: bars, clubs, parties, concerts, museums, fairs, street carnival blocos, artists and venues. You can see what is on, save events, mark "Vou" (I'm going), favorite venues and artists, and build lists.
Event information comes from public sources and from organizers and may change at any time: date, time, place, line-up, price, capacity, and even cancellation. We do not guarantee that it is complete, correct or up to date. Always confirm with the organizer or the venue before you go out.
3. Minimum age
The minimum age to use Borah is the age rating of the app in the app store, and never under 13. The app lists bars, clubs and other events where alcohol may be served; selling alcohol to anyone under 18 is prohibited by Brazilian law. Borah does not sell alcohol and does not encourage consumption by minors or excessive drinking. If you are a minor, use the app with the knowledge and guidance of your parent or guardian.
4. Free to use and sponsored content
You never pay to use Borah. There is no subscription, fee or paid plan for people who use the app. The app may show sponsored content, always labelled as such. Sponsored content is not an endorsement by Borah.
5. Tickets and third parties
Borah does not sell tickets and does not intermediate purchases. Links in the app lead to third-party sites and services (ticket sellers, organizers, venues, social networks), and those third parties' terms, prices, fees, refund policies and privacy policies apply. Borah is not a party to the relationship between you and those third parties and is not responsible for their sites and services, or for whether an event takes place, its quality, its safety or its cancellation, without prejudice to the rights the law gives you.
6. Account and guest use
- No password. To create an account or sign in, you enter your e-mail and we send you a sign-in link. Keep access to your e-mail secure: whoever opens the link signs in to the account.
- Guest. You can use the app without creating an account. Your saves and favorites are kept for your device and move to your account if you create one later.
- Deletion. You can delete your account at any time: in the app, under Perfil › Conta e Notificações › Excluir conta, or on the web at https://borahsp.com/delete-account. Details are in the Privacy Policy.
- Privacy. How we process your personal data is explained in the Privacy Policy.
7. Acceptable use
When using Borah you agree not to:
- collect data from the app or the service in an automated way (scraping, bots, crawlers), or overload or try to take down the service;
- reverse engineer, decompile or try to obtain the source code of the app, or bypass security or rate-limiting measures;
- impersonate another person, an organizer, a venue or Borah, or create accounts to deceive others;
- use the app for unlawful purposes, to harass, threaten or discriminate against people, or to send spam;
- access accounts, data or areas of the service that are not yours.
8. Content you create
Shared lists, names, usernames and any other content you create or publish in the app are your responsibility. You state that you have the right to publish it and that it does not violate the law or the rights of others. You keep ownership of what you create and authorize us to display it in the app to the extent needed for the service to work (for example, showing a list you chose to share).
Borah may remove content and suspend or end accounts that violate these terms or the law. Where possible we will tell you, and you can contest the decision by writing to contato@borahsp.com.
9. Intellectual property
The app, the Borah name and brand, the design, the texts and the code belong to Eduardo Torres Lopes or are licensed to him, and are protected by applicable law. These terms give you no right over them other than a personal, non-exclusive, revocable right to use the app under these terms. Third-party marks, names, logos and images (organizers, venues, artists, ticket sellers) belong to their respective owners and appear in the app only to identify events.
10. Availability and limitation of liability
We do our best to keep Borah running and accurate, but the service is provided as it is, and interruptions, errors and changes may occur. To the extent Brazilian law allows, Borah is not liable for damages arising from outdated or incorrect event information, from events that are cancelled, changed or run by third parties, from third-party sites and services, or from use of the app contrary to these terms.
Nothing in these terms excludes or limits rights that the law does not allow to be excluded or limited, in particular those under the Brazilian Consumer Defense Code (Law No. 8,078/1990), nor liability for willful misconduct or gross negligence. If any clause is found invalid or abusive, the others remain in force.
11. Changes to these terms
We may update these terms. The version in force is the one published on this page, with the "Last updated" date at the top. For a material change, we will tell you inside the app. If you keep using the app after a change, it applies to you; if you disagree, you can stop using the app and delete your account.
12. Governing law and venue
These terms are governed by Brazilian law. As a consumer, you may bring any action in the courts of your place of residence, as provided by the Consumer Defense Code.
